When purchasing goods in the online store, a Distance Agreement is concluded between you and the Seller, therefore we ask you to familiarize yourself with the terms that determine the business relationship. The agreement is concluded when you indicate your acceptance by completing the purchase process. If you do not agree with the terms of the Distance Agreement, you can place an order without payment and contact us for an individual agreement.
1. Terms used in the Agreement
Withdrawal form – a specified sample form that, when filled out and submitted to the seller, allows the buyer to exercise withdrawal rights.
Distance Agreement – an agreement concluded between the seller and the buyer for the purchase of goods in the online store, which defines the rights, obligations, and responsibilities of the parties.
Online store – a website maintained by the seller with the online store www.motoveikals21.lv
Client – a registered buyer who has provided their data to the seller by filling out the online store registration form.
Terms – terms of use of the online store.
Order – an order for goods placed in the online store, which includes all the goods the buyer wishes to purchase from the seller and which are indicated in one order, and on the basis of which the Seller sends a confirmation to the buyer.

Buyer – a natural or legal person represented by its representative who purchases goods by placing an order or making a purchase.
Purchase – a paid order that includes all the goods the buyer wishes to purchase from the seller and which are indicated in one order.
Goods – products offered for purchase.
2. Distance Agreement
2.1. The Distance Agreement is concluded (comes into force) when the buyer has made a purchase (payment for the order) in the online store or when the payment for the order is credited to the seller's bank account according to the information received by email about the payment.
2.2. When shopping in the online store, the current version of the Distance Agreement and the terms in force at the time of ordering the goods apply to the buyer, so the buyer must familiarize themselves with the terms of the Distance Agreement each time an order is placed. The seller has the right to unilaterally change, update, and supplement the terms of the Distance Agreement.
3. Registration
3.1. The buyer can make a purchase in the online store either by registering or not registering.
3.2. The seller processes the buyer's personal data in accordance with the privacy policy. Please read it carefully and ensure that the terms of the privacy policy are understood and accepted. Privacy policy
3.3. The buyer is responsible for ensuring that all data provided by the buyer is true and complete.
3.4. The seller is not responsible for any losses incurred by the buyer if the buyer has provided incorrect or incomplete data, as well as if the confirmation or payment information sent to the buyer's specified email address is not received.
3.5. Registration can be done by starting the payment process or in the “My Account” section.
3.6. When registering, the registration form must be filled out, indicating the following data: name, surname, email address, and delivery address of the goods. A username and password must be chosen. The information provided in the registration form is stored and used for the buyer's future purchases.
3.7. If the client's data changes, the client is responsible for updating it before making a purchase or order.
3.8. If the client loses or forgets their access data to the online store, it is possible to request a password reset using the option “Forgot your password?”
3.9. The client is responsible for storing their access information (username, password) and for any action taken in the online store using the client's access data.
3.10. The client at any time freely change or supplement your data.
3.11. An unregistered user must re-enter the data for each purchase.
4. Product prices
4.1. Prices are indicated in EUR including VAT. Delivery costs are not included in the product price.
4.2. The seller has the right to change product prices in the online store without prior notice. When the price changes, the product is sold to the buyer at the price in effect at the time of purchase or order.
5. Order and Purchase, payment procedure, and terms
5.1. When ordering a product, the buyer selects it in the catalog and adds it to the “Add to cart”.
5.2. In the “Shopping cart” section, it is possible to view the selected products, change their quantity, remove individual products, and choose the delivery method.
5.3. After all the desired products are added to the “Cart”, payment can be made.
5.4. The buyer pays for the products in advance by bank transfer, paying the seller’s electronically sent payment information using internet banking, or by credit card, or choosing Inbank installment or pay in parts - read more about this payment method here https://inbank.lv/documents/lv/lv/pdf/pay_later_conditions.pdf
5.5. The buyer must make the payment immediately after receiving the payment information, indicating the order or invoice number if requested.
5.6. Order
5.6.1. When placing an order, if payment for the selected products is not made, they are not reserved.
5.6.2. After receiving the payment, the seller sends the product to the buyer.
5.6.3. Orders can also be placed by calling (+371) 26076289 or using the WhatsApp application on working days from 10:00 to 19:00 and on Saturdays from 10:00 to 16:00. The terms of the distance contract, as far as possible, also apply to orders by phone.
5.7. Purchase
5.7.1. Purchases can be made by both registered and unregistered users.
5.7.2. In the “Order product” section, it is possible to change the delivery address, choose the delivery method, provide special instructions, for example, about delivery details, and choose the payment method.
5.7.3. After successful purchase payment, a confirmation of the purchase is sent to the buyer’s email.
6. Product delivery
6.1. The buyer pays the delivery fee for product delivery, including in cases where the order amount exceeds 50.00 (fifty euros and 00 euro cents) and it is not heavier than 30 kg
6.2. Delivery methods and costs:

6.3. If product delivery is delayed due to unforeseen circumstances beyond the seller’s control, the seller contacts the buyer and agrees on changes.
6.4. The fact of receiving the product is confirmed by:
6.4.1. Receiving the purchase with a courier – the buyer’s signature on the courier’s electronic terminal or the courier’s note about delivery. If packaging damage is detected at the time of delivery, the recipient of the purchase must check the contents of the purchase with the courier and, in case of damage, ask the courier to prepare a report on the damaged shipment. The recipient has the right to return the damaged shipment to the courier or keep it if the damage is insignificant.
6.4.2. Receiving the purchase in a parcel machine – the buyer’s manual code entry to retrieve the product purchase. If packaging damage is detected at the time of receiving the purchase in the parcel machine, the order recipient must immediately file a complaint by filling out a form on the parcel machine’s website and contacting seller.
6.4.3. When collecting the purchase via self-pickup, the buyer presents the order number or payment information (image) and receives a receipt copy for the payment, the original receipt confirms the receipt of the goods.
6.5. The buyer is obliged to check the quantity, quality, and configuration of the goods within 5 (five) working days from the moment of receiving the purchase. If the buyer discovers any damage or defects in the goods, they must immediately, but no later than within 5 (five) working days from the moment of receiving the purchase, send a photo(s) clearly showing the damage, along with a description of the problem, by filling out the contact form on the website motoveikals21.lv. The seller will contact the buyer within 3 (three) working days to resolve the situation. If the buyer does not submit a complaint to the seller within the specified period, it is assumed that the packaging of the goods is in proper condition, and the quantity, quality, assortment, accessories, and configuration comply with the terms of the purchase agreement and the product description in the online store.
6.6. If the delivery of goods is not possible due to the buyer's fault or circumstances beyond the seller's control (for example, the buyer has provided an incorrect delivery address, the buyer or their authorized person is not present at the specified address, it is not possible to contact the buyer at the specified time, the specified address is inaccessible, etc.) and the supplier returns the shipment, the payment for the unreceived goods and delivery costs is not refunded. The goods are sent again if the buyer pays for the repeated delivery of the goods. The buyer is responsible for correcting the address.
7. Right of withdrawal (for consumers). Exchange and return of goods
7.1. The buyer can exercise the right of withdrawal and unilaterally withdraw from the distance contract (purchase of goods in the online store) within 14 (fourteen) calendar days after receiving the goods.
7.2. The buyer cannot exercise the right of withdrawal for goods that are made or ordered specifically for the buyer according to an individual order if the goods have lost their original appearance, the packaging is damaged, or the product logos are removed.
7.3. To exercise the right of withdrawal, the buyer must fill out and sign the withdrawal form, providing the requested data, and send it to the seller via email: info@motoveikals.lv.
7.4. The buyer sends the goods back to the seller by mail in the same packaging as received within 14 (fourteen) days after receiving the goods – Motoveikals21, SIA “European Trade Partners”, Raiņa iela 16, Jelgava, LV3001, by delivering the goods personally to Motoveikals21, Raiņa iela 16, Jelgava, or using courier services. All expenses incurred in returning the goods to the seller are covered by the buyer.
7.5. The seller refunds the price of the goods within 14 (fourteen) days after receiving the goods back, transferring the purchase amount to the bank account specified by the buyer.
7.6. The buyer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal. The buyer is responsible for any decrease in the value of the goods if the goods have been used in a manner incompatible with the principle of good faith, including used for purposes other than determining the properties or functioning of the goods. The seller is entitled to deduct the loss of value of the goods from the refund amount.
7.7. The seller has the right to refuse to accept the goods and deny the buyer the right of withdrawal, as well as not refund the money paid by the buyer for the goods in cases specified in the Cabinet of Ministers Regulation No. 255-22 of May 20, 2014.
7.8. The goods must be undamaged, retain their appearance, and be unused.
7.9. If the buyer exercises the right of withdrawal or exchanges goods that comply with the buyer's order, the delivery fee is not refunded to the buyer.
8. Quality and expiration of goods
8.1. The images of goods in the online store is of informational nature. The goods shown in the images may differ in shape and other parameters from the actual sizes, shapes, and colors of the goods.
8.2. The color of the product in photos may differ from the actual color of the product. This is related to color rendering issues on various monitors, camera settings, and other factors.
9. Non-compliant goods
The buyer submits an application for non-compliant goods, as well as the non-compliant goods themselves, to the seller in free form, indicating their name, surname, residential address, and contact information, as well as providing a description of how the non-compliance of the goods manifests, and attaches copies of transaction-confirming documents, as well as other documents supporting the application (if possible). The buyer sends the application to the seller via the email address info@motoveikals21.lv. The application will be reviewed in accordance with the procedures and deadlines set by the Consumer Rights Protection Law.
10. Information exchange
The buyer sends all notifications and questions using the contact means and addresses specified in the "Contacts" section of the online store.
11. Dispute resolution
11.1. Consumer disputes are resolved out of court by the Consumer Out-of-Court Dispute Resolution Commission, address: Brīvības iela 55, Riga, Latvia, LV-1010.
12. Final provisions
12.1. The laws of the Republic of Latvia apply to the terms and relations between the parties in accordance with these Terms, and they are interpreted based on the laws of the Republic of Latvia.
12.2. Disputes arising from or related to these Terms, their violation, termination, or validity, are finally resolved in accordance with the procedures specified in the legal acts of the Republic of Latvia.
12.3. The terms are effective from August 10, 2024.
