The Seller shall arrange delivery of the goods upon receipt of payment for the order. If the goods are in stock, the estimated delivery time is up to 3 working days, unless otherwise specified.

If the goods ordered are not available in stock, the Buyer shall be informed separately of the estimated delivery time.

Delivery costs depend on the weight, size, delivery method and address of the goods. The exact delivery charge is specified at the time of order placement.

The delivery of the goods shall be carried out by third party courier service providers with whom the Seller cooperates.

The Buyer is obliged to provide an accurate and complete delivery address and contact details. The Seller shall not be liable for any delay or impossibility of delivery caused by inaccuracies in the information provided by the Buyer.

The Buyer has the right to withdraw from goods purchased under a distance contract within 14 calendar days from the date of receipt of the goods, provided that the goods are unused and meet the conditions for return.

In order to exercise the right of withdrawal, the Buyer shall notify the Seller in writing by sending a withdrawal application to and within 7 days after sending the withdrawal notification, hand over the goods to the Seller in person at Motoveikals21, Raiņa iela 16, Jelgava, or send them by courier. The Buyer shall bear the costs of returning the goods.

Restrictions on the right of withdrawal

The right of withdrawal does not apply to goods if:

* the goods have been specially ordered at the Buyer's individual request and are not in the Seller's regular assortment (Paragraph 22.3 of Cabinet of Ministers Regulation No 255);
* the goods are used, damaged or not in the same condition as when they were originally purchased;
* the Goods are substantially damaged or the original packaging has been lost, which exceeds the time required to open the packaging to inspect the Goods.

In such cases, the Seller shall be entitled to assess the diminution in value of the goods and to withhold compensation accordingly.

Specially ordered goods

Goods which are ordered from the Supplier on the Buyer's instructions (part code, configuration, etc.) and which are not in the Seller's regular assortment shall be considered as special orders. Such goods are not subject to the right of withdrawal of the distance contract.

Claims for non-conformity

In the event of suspected non-conformity or manufacturing defect, the Buyer shall submit a written claim and hand over the goods to the Seller for evaluation. The claim shall be examined within 15 working days from the date of receipt of the goods.

If necessary, the Seller may request a service report or other technical information to objectively assess the condition of the goods.

Motorcycle electrical goods

Motorcycle electrical items (ignition modules, coils, sensors, governor rectifiers, etc.) shall not be subject to a right of withdrawal after unpacking, except in the case of a manufacturing defect or non-conformity. Before placing an order, the Buyer is obliged to check the compatibility of the product with his/her vehicle.

Batteries

In accordance with EU Regulation (EU) 2019/1148, lead-acid batteries that require manual charging of the electrolyte are prepared for use prior to sale.

After refilling, batteries are not accepted for return unless a manufacturing defect is detected.

Batteries are covered by a 6-month warranty, which applies only to manufacturing defects. The warranty does not cover damage caused by improper installation, operation or charging.

Pircējs veic preču pasūtīšanu, izvēloties preces interneta veikalā un norādot to veidu un daudzumu. Samaksa par pasūtījumu var tikt veikta, izmantojot tiešo Klix bankas maksājumu no Pircēja bankas konta vai citus interneta veikalā piedāvātos maksājumu veidus.

Klix ir licencēts maksājumu ierosināšanas pakalpojuma sniedzējs, kas darbojas saskaņā ar Eiropas Savienības normatīvajiem aktiem par maksājumu pakalpojumiem (PSD2 - Direktīva (ES) 2015/2366).

Pēc pasūtījuma noformēšanas Pārdevējs sagatavo elektronisku rēķinu un nosūta to Pircējam uz norādīto e-pasta adresi. Elektroniski sagatavots rēķins ir derīgs bez paraksta saskaņā ar Latvijas Republikas normatīvajiem aktiem.

Pasūtījums tiek uzskatīts par apmaksātu brīdī, kad Pārdevēja bankas kontā ir saņemta samaksa par pasūtījumu.

Iegādājoties preces interneta veikalā www.motoveikals21.lv, starp Pircēju un Pārdevēju tiek noslēgts distances līgums. Līguma noslēgšana notiek brīdī, kad Pircējs ir apstiprinājis pasūtījumu un veicis apmaksu. Lūdzam iepazīties ar šiem noteikumiem pirms pasūtījuma veikšanas.

Ja Pircējs nepiekrīt distances līguma noteikumiem, pasūtījumu iespējams veikt bez apmaksas un sazināties ar Pārdevēju par individuāla līguma noslēgšanu.

1. Līgumā lietotie termini

Atteikuma veidlapa – noteikta parauga veidlapa, ar kuru Pircējs var izmantot atteikuma tiesības.
Distances līgums – līgums par preču iegādi interneta veikalā, kas noslēgts attālināti.
Interneta veikals – Pārdevēja uzturēta tīmekļa vietne www.motoveikals21.lv

Pārdevējs – SIA “European Trade Partners”, reģ. Nr. 43603064507, Raiņa iela 16, Jelgava, LV-3001, Latvija.
Pircējs – fiziska vai juridiska persona, kas veic pasūtījumu interneta veikalā.
Pasūtījums – Pircēja veikta preču izvēle un noformēšana interneta veikalā.
Pirkums – apmaksāts pasūtījums.
Prece – interneta veikalā piedāvātās preces.

2. Distances līguma noslēgšana

2.1. Distances līgums stājas spēkā brīdī, kad Pārdevēja bankas kontā tiek saņemta samaksa par pasūtījumu.
2.2. Pircējam tiek piemērota noteikumu redakcija, kas ir spēkā pasūtījuma veikšanas brīdī.
2.3. Pārdevējam ir tiesības mainīt noteikumus, publicējot aktuālo redakciju interneta veikalā.

3. Reģistrācija

3.1. Pirkumu interneta veikalā var veikt gan reģistrēti, gan nereģistrēti lietotāji.
3.2. Pircējs ir atbildīgs par sniegto datu pareizību un aktualitāti.
3.3. Personas datu apstrāde notiek saskaņā ar Privātuma politiku.

4. Preču cenas

4.1. Visas cenas norādītas eiro (EUR) ar pievienotās vērtības nodokli (PVN).
4.2. Piegādes izmaksas nav iekļautas preces cenā.
4.3. Prece tiek pārdota par cenu, kas ir spēkā pasūtījuma veikšanas brīdī.

5. Pasūtījuma veikšana un apmaksa

5.1. Pircējs izvēlas preces interneta veikalā un pievieno tās grozam.
5.2. Pasūtījuma apmaksa tiek veikta ar bankas pārskaitījumu, maksājumu karti vai citām piedāvātajām maksājumu metodēm.
5.3. Pasūtījums tiek izpildīts pēc apmaksas saņemšanas.

6. Preču piegāde

6.1. Piegādes veids un izmaksas tiek norādītas pasūtījuma noformēšanas laikā.
6.2. Ja piegāde kavējas no Pārdevēja neatkarīgu iemeslu dēļ, Pārdevējs informē Pircēju.
6.3. Pircējam ieteicams pēc preces saņemšanas nekavējoties pārbaudīt iepakojumu un preces stāvokli.

7. Atteikuma tiesības

7.1. Pircējam ir tiesības atteikties no distances līgumā iegādātas preces 14 kalendāro dienu laikā no preces saņemšanas dienas, ja normatīvie akti neparedz izņēmumus.
7.2. Lai izmantotu atteikuma tiesības, Pircējs rakstiski informē Pārdevēju un nodod preci atpakaļ 14 dienu laikā pēc atteikuma paziņojuma nosūtīšanas.
7.3. Atgriešanas izdevumus sedz Pircējs.

8. Atteikuma tiesību izņēmumi

Atteikuma tiesības neattiecas uz precēm, kas:

* izgatavotas vai pasūtītas pēc Pircēja individuāla pieprasījuma un nav Pārdevēja pastāvīgajā sortimentā (MK noteikumu Nr. 255 22.3. punkts);
* ir lietotas vai bojātas;
* ir zaudējušas sākotnējo izskatu vairāk, nekā tas nepieciešams preces pārbaudei.

Šādos gadījumos Pārdevējam ir tiesības izvērtēt preces vērtības samazinājumu.

9. Preces neatbilstība līguma noteikumiem

Ja Pircējs konstatē, ka prece neatbilst līguma noteikumiem, Pircējs iesniedz rakstisku pretenziju un nodod preci Pārdevējam izvērtēšanai.
Pretenzija tiek izskatīta 15 darba dienu laikā no preces saņemšanas dienas saskaņā ar Patērētāju tiesību aizsardzības likumu.

10. Informācijas apmaiņa

Saziņa starp Pircēju un Pārdevēju notiek, izmantojot interneta veikalā norādītos kontaktus.

11. Strīdu izšķiršana

Patērētāju strīdi tiek risināti Patērētāju ārpustiesas strīdu risināšanas komisijā vai normatīvajos aktos noteiktajā kārtībā.

12. Nobeiguma noteikumi

12.1. Šiem noteikumiem piemērojami Latvijas Republikas normatīvie akti.
12.2. Noteikumi ir spēkā no 2024. gada 10. augusta.
