The Buyer has the right to withdraw from goods purchased under a distance contract within 14 calendar days from the date of receipt of the goods, provided that the goods are unused and meet the conditions for return.
In order to exercise the right of withdrawal, the Buyer shall notify the Seller in writing by sending a withdrawal application to and within 7 days after sending the withdrawal notification, hand over the goods to the Seller in person at Motoveikals21, Raiņa iela 16, Jelgava, or send them by courier. The Buyer shall bear the costs of returning the goods.
Restrictions on the right of withdrawal
The right of withdrawal does not apply to goods if:
* the goods have been specially ordered at the Buyer's individual request and are not in the Seller's regular assortment (Paragraph 22.3 of Cabinet of Ministers Regulation No 255);
* the goods are used, damaged or not in the same condition as when they were originally purchased;
* the Goods are substantially damaged or the original packaging has been lost, which exceeds the time required to open the packaging to inspect the Goods.
In such cases, the Seller shall be entitled to assess the diminution in value of the goods and to withhold compensation accordingly.
Specially ordered goods
Goods which are ordered from the Supplier on the Buyer's instructions (part code, configuration, etc.) and which are not in the Seller's regular assortment shall be considered as special orders. Such goods are not subject to the right of withdrawal of the distance contract.
Claims for non-conformity
In the event of suspected non-conformity or manufacturing defect, the Buyer shall submit a written claim and hand over the goods to the Seller for evaluation. The claim shall be examined within 15 working days from the date of receipt of the goods.
If necessary, the Seller may request a service report or other technical information to objectively assess the condition of the goods.
Motorcycle electrical goods
Motorcycle electrical items (ignition modules, coils, sensors, governor rectifiers, etc.) shall not be subject to a right of withdrawal after unpacking, except in the case of a manufacturing defect or non-conformity. Before placing an order, the Buyer is obliged to check the compatibility of the product with his/her vehicle.
Batteries
In accordance with EU Regulation (EU) 2019/1148, lead-acid batteries that require manual charging of the electrolyte are prepared for use prior to sale.
After refilling, batteries are not accepted for return unless a manufacturing defect is detected.
Batteries are covered by a 6-month warranty, which applies only to manufacturing defects. The warranty does not cover damage caused by improper installation, operation or charging.
