When purchasing goods in the online store www.motoveikals21.lv, a distance contract is concluded between the Buyer and the Seller. The conclusion of the contract takes place when the Buyer has confirmed the order and made the payment. Please read these terms and conditions before placing an order.
If the Buyer does not agree to the terms of the distance contract, the order may be placed without payment and the Seller contacted to conclude an individual contract.
1. Terms used in the Contract
Cancellation Form - a form of a specified format by which the Buyer may exercise the right of cancellation.
Distance Contract - a contract for the purchase of goods in an online shop concluded remotely.
Online Shop - the website www.motoveikals21.lv maintained by the Seller
Seller - European Trade Partners Ltd, reg. No. 43603064507, Raiņa iela 16, Jelgava, LV-3001, Latvia.
Buyer - a natural or legal person who places an order in the online shop.
Order - selection and placement of goods in the online shop by the Buyer.
Purchase - a paid order.
Product - the goods offered in the online shop.
2. Distance Contract
2.1 The Distance Contract shall come into force when the payment for the order is received in the Seller's bank account.
2.2 The Buyer shall be bound by the version of the Terms and Conditions in force at the time the order is placed.
2.3 The Seller shall be entitled to change the Terms and Conditions by publishing the current version in the online shop.
3. Registration
3.1 Purchases can be made in the online shop by both registered and non-registered users.
3.2 The Buyer is responsible for the accuracy and up-to-dateness of the data provided.
3.3 Processing of personal data shall be in accordance with the Privacy Policy.
4. Prices
4.1 All prices are quoted in Euro (EUR) inclusive of Value Added Tax (VAT).
4.2 Delivery costs are not included in the price of the goods.
4.3 The Goods are sold at the price prevailing at the time the order is placed.
5. Placing and payment of the order
5.1 The Customer selects the goods in the online shop and adds them to the basket.
5.2 Payment of the order is made by bank transfer, credit card or other payment methods offered.
5.3 The order is executed upon receipt of payment.
6. Delivery
6.1 The method and cost of delivery shall be specified at the time of placing the order.
6.2 If delivery is delayed for reasons beyond the Seller's control, the Seller shall inform the Buyer.
6.3 The Buyer is advised to inspect the packaging and condition of the Goods immediately upon receipt.
7. Right of withdrawal
7.1 The Buyer shall have the right to withdraw from the goods purchased under a distance contract within 14 calendar days from the date of receipt of the goods, unless the laws and regulations provide for exceptions.
7.2 To exercise the right of withdrawal, the Buyer shall notify the Seller in writing and return the goods within 14 days of the date of dispatch of the notice of withdrawal.
7.3 The Buyer shall bear the costs of return.
8. Exceptions to the right of withdrawal
The right of withdrawal does not apply to goods which:
* made or ordered at the Buyer's individual request and not in the Seller's regular assortment (Paragraph 22.3 of Cabinet Regulation No. 255);
* are used or damaged;
* have lost more of their original appearance than is necessary for the inspection of the goods.
In such cases, the Seller shall be entitled to assess the diminution in value of the goods.
9. non-conformity of the goods with the terms of the contract
If the Buyer finds that the goods do not comply with the terms of the contract, the Buyer shall submit a written claim and hand over the goods to the Seller for evaluation.
The complaint shall be examined within 15 working days from the date of receipt of the goods in accordance with the Consumer Rights Protection Act.
10. Exchange of information
Communication between the Buyer and the Seller shall take place through the contacts indicated in the online shop.
11. Dispute resolution
Consumer disputes shall be settled by the Consumer Out-of-Court Dispute Settlement Commission or in accordance with the procedure established by the laws and regulations.
12. Final provisions
12.1 The laws and regulations of the Republic of Latvia shall apply to these Terms and Conditions.
12.2 The Rules shall be effective as of 10 August 2024.
