Terms of Use for www.motoveikals21.lv
When purchasing goods from the online store www.motoveikals21.lv, a distance contract is concluded between the Buyer and the Seller. The contract is concluded when the Buyer confirms the order and makes payment. Please review these terms before placing an order.
If the Buyer does not agree to the terms of the distance contract, they may place an order without payment and contact the Seller to enter into an individual contract.
1. Terms Used in the Contract
Withdrawal Form – a standard form that the Buyer may use to exercise their right of withdrawal.
Distance Contract – a contract for the purchase of goods from an online store, concluded remotely.
Online Store – the website maintained by the Seller at www.motoveikals21.lv
Seller – SIA “European Trade Partners,” Reg. No. 43603064507, Raiņa iela 16, Jelgava, LV-3001, Latvia.
Buyer – a natural or legal person who places an order in the online store.
Order – The selection and placement of goods by the Buyer in the online store.
Purchase – A paid order.
Goods – The goods offered in the online store.
2. Conclusion of the Distance Contract
2.1. The distance contract takes effect when payment for the order is received in the Seller’s bank account.
2.2. The version of the Terms and Conditions in effect at the time the order is placed applies to the Buyer.
2.3. The Seller has the right to amend the Terms and Conditions by publishing the current version on the online store.
3. Registration
3.1. Both registered and unregistered users may make purchases in the online store.
3.2. The Buyer is responsible for the accuracy and timeliness of the information provided.
3.3. Personal data is processed in accordance with the Privacy Policy.
4. Product Prices
4.1. All prices are listed in euros (EUR) and include value-added tax (VAT).
4.2. Shipping costs are not included in the price of the goods.
4.3. The product is sold at the price in effect at the time the order is placed.
5. Placing an Order and Payment
5.1. The buyer selects items in the online store and adds them to the cart.
5.2. Payment for the order is made via bank transfer, credit card, or other available payment methods.
5.3. The order is processed upon receipt of payment.
6. Delivery of Goods
6.1. The delivery method and costs are specified when the order is placed.
6.2. If delivery is delayed for reasons beyond the Seller’s control, the Seller will notify the Buyer.
6.3. The Buyer is advised to inspect the packaging and the condition of the goods immediately upon receipt.
7. Right of Withdrawal
7.1. The Buyer has the right to withdraw from a distance contract for goods purchased within 14 calendar days from the date of receipt of the goods, unless otherwise provided by law.
7.2. To exercise the right of withdrawal, the Buyer must notify the Seller in writing and return the goods within 14 days after sending the notice of withdrawal.
7.3. The Buyer is responsible for the return shipping costs.
8. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to goods that:
* are manufactured or ordered at the Buyer’s individual request and are not part of the Seller’s regular product lineup (Cabinet of Ministers Regulation No. 255, Section 22.3);
* have been used or damaged;
* have lost their original appearance to a greater extent than is necessary for inspecting the goods.
In such cases, the Seller has the right to assess the reduction in the value of the goods.
9. Non-conformity of the Goods with the Terms of the Contract
If the Buyer finds that the goods do not comply with the terms of the contract, the Buyer shall submit a written complaint and return the goods to the Seller for evaluation.
The claim will be reviewed within 15 business days from the date of receipt of the goods in accordance with the Consumer Protection Law.
10. Exchange of Information
Communication between the Buyer and the Seller takes place using the contact information provided on the online store.
11. Dispute Resolution
Consumer disputes are resolved by the Consumer Out-of-Court Dispute Resolution Commission or in accordance with the procedures established by law.
12. Final Provisions
12.1. These Terms are governed by the laws of the Republic of Latvia.
12.2. These Terms are effective as of August 10, 2024.
